You see those images above? Does it look like the same? The first picture above is the Tomita Technologies' patent, which has a resemblance on the next picture, the concept of the 3ds screen tech. Tomita patented this technology at year 2008, and may result to patent infringement by Nintendo.
Also, the company is seeking a trial by jury, and awaits a decision by the court according to image shack. I think it's not right to sue Nintendo because they did use the technology but they're not the one who created it.

Sharp, the company that always make screens for Nintendo handhelds, maybe the one who's responsible for making the said "copy" of the technology mass marketed for the Nintendo 3ds. It's only my opinion though, and this situation already happened before, when the time wii remote appears and Nintendo started to profit, thinking that this issue on patents is a marketing strategy. I don't know what will happen to 3ds, but I think this won't be a big problem for Ninty.
